International procedural form of human liberties defence
The article is devoted to the current importance issues of international procedural form of human liberties defence. In the context of broad approach to juridical procedure the main principals and regularities of procedural form of contraversion defence in international jurisdictional institutions are investigated. The author proves the illegitimacy of considering production in European Human Liberties Court as data domain of international private law. The notion “procedural legal system” is introduced with the purpose of analyzing the interaction of national and international procedural legal measures. The description of structural elements of international procedural and legal mechanism of human liberties defence is given.
